Disputes About Commercial Leases and Tenancies

Leasing commercial premises can be a complex area of law for both landlords and tenants.

The consequences of a wrong move by either landlord or tenant – whether before, during, or at the end of a tenancy – can be costly.

A lease is a significant financial and legal commitment. There are often duties and obligations built into a lease that are not readily apparent, and that can have important repercussions for your business operations.

The goal should always be to avoid or minimize surprises and disputes. Addressing issues early, before they escalate, is usually the best way to achieve this outcome.

We can review leases and help landlords and tenants negotiate terms. When disputes do arise, we can provide strategic advice on the best way to handle them, whether that be through a negotiated resolution, litigation, or arbitration proceedings.

Representing Owners In Landlord/Tenant Disputes

We work with owners of retail space, office buildings, warehouses, and other commercial and industrial properties in litigation that involves:

  • Lease violations
  • Unpaid rent or back rent
  • Early termination
  • Renewals
  • Property damage
  • Real estate transactions
  • Evictions

If you are beginning the process of eviction, it is important that you obtain competent legal advice to ensure the lawful exercise of your rights as a landlord. Our firm can guide you through the process to ensure that you obtain the intended outcome efficiently and cost-effectively. We can answer all of your questions and address your concerns for landlord/tenant disputes.

Situation

A glazing subcontractor’s work on a large commercial construction project was delayed and compromised due to the negligence of another subcontractor.

Issue

The head contractor blamed the glazing subcontractor, refused to pay outstanding invoices, and asserted a deficiency set-off, resulting in significant financial prejudice.

Our role

McKechnie & Company filed a builders lien against the project, commenced legal proceedings to enforce the lien and recover the debt, obtained expert evidence to support the subcontractor’s position, and guided the matter through mediation.

Outcome

On the eve of a lengthy trial, the parties reached a negotiated settlement.
